1. Acceptance of These Terms

These Terms of Service form a binding agreement between the visitor or guest and Blue Juniper Private Retreat LLC. A person accepts the terms by using the website, by sending an enquiry, or by confirming a booking. The company may also present these terms at the time of confirmation, and acceptance of a held date is treated as acceptance of the terms in force on that date.

The terms should be read together with the privacy policy, which explains how information is handled. Where a specific written booking agreement has been signed for a large event or a long residency, that agreement takes priority over these general terms if the two differ. Otherwise these terms govern the relationship in full.

2. Who These Terms Cover

These terms cover the lead guest who makes the booking and, through that guest, every member of the party. The lead guest is responsible for sharing these terms with the rest of the group and for making sure that everyone understands the rules of the property. Where a booking is made for a company, the person who confirms the booking represents that they are authorised to act for that company.

The services are intended for adults arranging stays and events. A person who is under the age required to form a contract in their region may use the services only with the involvement of a parent or guardian. The company relies on the lead guest to ensure that all members of a party are properly informed and that any access requirements or support needs are made known in advance.

3. Services We Provide

Blue Juniper Private Retreat LLC operates a private, gated canyon property near Kanab, Utah. The services include private retreat residencies, desert garden venues, corporate offsite programs, wellness workshop weekends, retreat property management and the booking and guest systems that support them. Each service is described on the website, and the description forms part of the basis of the agreement for that service.

The property is reserved to one party at a time. This is a core feature of the service and part of what a guest is paying for. The company may adjust small details of a stay, such as the arrangement of seating or the timing of a grounds visit, where this is needed for safety, weather or the good order of the property. Any substantial change to a confirmed booking will be discussed with the lead guest first.

4. Booking and Enquiries

A booking begins with an enquiry. The company reads each enquiry by hand and checks it against the residency calendar. A date is held for a limited time once the company offers it, and the hold is released if the guest does not confirm within that period. A booking is confirmed only when the terms have been accepted in writing and the required deposit has been received.

The lead guest is responsible for the accuracy of the information given at the time of booking, including the number of guests and the dates requested. If that information changes, the lead guest must tell the company promptly so that the residency can be adjusted or re-arranged. An enquiry does not create a booking, and the company is not obliged to hold a date until the confirmation steps are complete.

5. Payments and Deposits

A deposit is required to confirm a booking, and the balance is payable by the date stated in the confirmation. Payment terms for a residency, an offsite or an event are set out in the confirmation message. Where a booking is made close to the arrival date, the full amount may be due at the time of confirmation rather than on a later date.

Payments are arranged directly with Blue Juniper Private Retreat LLC. If a payment is late, the company may treat the booking as at risk and may release the held dates after giving the lead guest notice. Amounts already paid are handled in line with the cancellation rules in these terms. Fees are stated in United States dollars unless another currency is agreed in writing.

6. Cancellation and Changes

A guest may cancel or change a booking by writing to booking@bluejuniperretreat.mom or by calling +19288326968. The effect of a cancellation depends on how close it is to the arrival date and on the nature of the booking, and the applicable terms are set out in the confirmation. The company aims to be fair and will try to move a booking to another date where the calendar allows.

The company may cancel or change a booking where the property cannot safely be used, where a legal or safety requirement intervenes, or where the weather or the condition of the land makes a stay unwise. In such a case the company will offer an alternative date or a refund of amounts paid for the affected booking. The company is not responsible for costs a guest incurs outside the booking, such as travel arrangements, and guests are encouraged to hold suitable travel cover.

7. Arrival and Gate Access

The property is at 8667 E Serenity Rd, Kanab, UT 84741-1256, United States (US). Gate access is provided to the lead guest before arrival, and the gate is opened for the party at the agreed time. Guests should not arrive outside the arranged window, because the property is private and the gate is not staffed around the clock. The lead guest is responsible for passing access details to the rest of the party and for making sure that no uninvited visitor is given access. The gate must be kept closed after arrival so that the privacy of the residency is preserved and so that the property remains secure. If a guest expects a late arrival or a change in timing, the company should be told in advance so that arrangements can be adjusted.

8. Guest Conduct on the Property

Guests are expected to treat the property, the garden and the surrounding land with care. The quiet of the canyon is a central part of the service, and parties are asked to keep noise at a level that respects the setting. Fires may be lit only in the designated fire ring and only when conditions allow, and all local rules about fire safety must be followed at all times.

The company may ask a guest to leave the property where conduct puts people, the land or the property at risk, where a serious rule is broken, or where the behaviour of a party disturbs the reasonable use of the site. In such a case the booking ends and no refund is due for the remaining time. The company will act proportionately and will explain the reason for any such decision.

9. Care of the Property

Guests are responsible for the property while it is in their care. Damage caused by a party, beyond ordinary wear, may be charged to the lead guest. The company asks guests to report any damage or fault promptly so that it can be put right before the next residency. Small accidents are understood, and the goal of this rule is to keep the property in good order for every party that follows.

Garden beds, stone borders, irrigation lines and gate hardware should not be altered. A guest who wishes to rearrange a venue should ask the company, which will make the change where it can be done safely. Anything left behind after departure will be kept for a reasonable period and can be returned at the guest cost if the guest asks for it within that period.

10. Limitation of Liability

The company takes reasonable care to keep the property safe, but the land is a natural desert setting with uneven ground, loose stone and variable weather. Guests use the property and the surrounding land at their own risk. To the fullest extent allowed by law, the company is not liable for indirect or consequential loss, for loss of profit or opportunity, or for loss arising from a guest decision to use the land in a way that was not intended.

Where liability cannot lawfully be excluded, the responsibility of the company is limited to the amount paid for the affected booking. Nothing in these terms limits liability where such a limit would be unlawful, including liability for death or personal injury caused by negligence where the law does not permit exclusion. Guests are encouraged to hold their own insurance for travel, health and personal property.

11. Indemnity

A guest agrees to indemnify Blue Juniper Private Retreat LLC against claims, losses and reasonable costs that arise from the guest use of the property, from damage caused by the guest party, or from a breach of these terms by the guest. This means that where a guest action leads to a cost for the company, the guest is responsible for that cost.

This indemnity does not apply where the loss was caused by the company own negligence or breach of these terms. It is intended to cover situations in which a guest or a member of a party acts outside the agreement, such as by damaging the property, by allowing unauthorised access, or by using the land in a way that was clearly not permitted.

12. Insurance and Personal Responsibility

Guests are responsible for their own travel, health and personal property insurance. The company does not insure the belongings of a guest and is not responsible for items lost, damaged or left behind. A guest who brings valuable equipment, such as cameras or instruments, should keep it secure and should hold suitable cover for it.

Because the property sits in a desert setting, guests should come prepared for sun, heat, cool evenings and limited services nearby. Personal responsibility includes sensible preparation for the conditions and reasonable care in moving around the land. The company is glad to offer guidance about the site before arrival, and guests are encouraged to ask questions in advance.

13. Intellectual Property

The content of this website, including its text, layout, imagery and code, belongs to Blue Juniper Private Retreat LLC or is used with permission. A visitor may read, share and print the content for personal and non-commercial use, but may not copy it into another website or use it for commercial purposes without written permission from the company.

The name Blue Juniper Retreat, the name Blue Juniper Private Retreat LLC and any associated marks are the property of the company. Nothing in these terms grants a licence to use those names or marks except where the company gives clear written permission. 14. Acceptable Use of the Website

A visitor agrees to use the website lawfully and in a way that does not harm the site or interfere with other users. These terms are governed by the laws of the State of Utah, United States, and any dispute is subject to the jurisdiction of the courts of that state, unless a mandatory rule of the guest home region requires otherwise. The company prefers to resolve a concern directly and asks that a guest raise the matter with the team before taking any formal step.

The company will look into the matter and respond within a reasonable time. Many concerns can be settled with a conversation, and the company is committed to dealing with disputes fairly and without unnecessary delay.

17. Changes to These Terms

A booking is governed by the terms in force when the booking was confirmed, unless the guest agrees to a later version for that booking.

Continued use of the website after a change means that the updated terms apply to that use. A visitor who does not agree with an update should stop using the website.
